Planet K fails to get mural defined as "fine art"

As expected, AusPro Enterprises/Planet K formally requested November 22nd that Bee Cave City Council classify the part of its mural with a Planet K’s logo as “fine art” - making it no longer subject to the City’s sign ordinance. After lengthy discussion and multiple comments by citizens, the Council voted unanimously to not grant such a classification.
Said Councilman Dorsett in his blog "The greatest concern I have in regards to the sign is the message it would send to the many businesses who have abided the sign ordinances in the past and what message it would send to future business owners in the future."
The Council also agreed with their outside counsel’s advice to take some of the fight with AusPro to federal court. This follows the failure of their case in City Court last month.

2011-11-25 16:07:22 | BobThe sky is falling, the sky is falling. What a powerful concern councilman.
The painted sign looks a lot better and cleaner than the 80's neons that are allowed to hang from the windows of several stores and eateries.
Have you ever looked up close at one of those neon signs ? It looks like a bug cemetery, just gross. Insects naturally are attracted to the lights of the signs and once they are trapped or burnt their bodies just stay there till eternity.

2011-11-26 09:13:08 | Kelly Ritter - We like the mural! This is the most petty, ridiculous event I've ever heard of. So you don't like the store (not a fan of it, or the Ron Paul sign, but I think it all will be fine in the end) so we are spending x# of dollars try to get them back via the mural? Really? My family and I like the mural- it depicts a happy hill country scene and it very pleasant to look it. It reminds us how lucky we are to live here. Why is this an issue? I really cannot understand where all of this energy is coming from- bored housewives, people without hobbies or jobs (or both), people that need vacations? Are parents so lazy that they cannot guide their children to manage around whatever products this store wants to sell? I certainly don't see any negative impact to the area around the store. Leave it alone and go take a hike- literally. If you can't think of a place maybe you should drive by the mural and it will give you some ideas on the beautiful areas depicted within.

2011-11-26 10:06:33 | Karen Miller - Fine Art?!Planet K believes their mural is "fine art." Perhaps they need to visit the National Gallery in Washington, D.C. for an education. Let's stop the spin, Planet K...you are what you are..stop hiding behind labels that do not apply.Do you think the citizens are stupid? If it walks like a duck, looks like a duck and quacks like a duck...it is a DUCK. In Planet K's situation it is what comes out of the backside of the duck. I rest my case.

2011-11-26 10:27:40 | ron doll - Poor Bee CavesYou actually voted for those idiots. How much money are the village morons willing to spend? You should have a recall election instead of going to Federal court. My sympathies to all you residents. RD

2011-11-28 15:29:37 | Mack - It's not the muralIf that mural was on a store selling cowboy boots, nobody would give sh*t. And nobody is going to turn back the clock for a few people who won't be re-elected and should get a life elsewhere if they don't like being a suburb of Austin. Wake up. Go somewhere you can yup and howdy yourselves and kick some dirt. Rising Star or Cisco or Circle Back. Bee Cave is not your little town any more.

They are no longer a village- they are a 3 square mile city I think.

2011-11-28 18:16:00 | Sarah Fletcher - What logo? There is no part of that mural with a logo. It is a beautiful mural painted by a well known artist. How is it not art? Planet K is not trying to hide who they are with a painting that actually ads beauty to the area. Planet K is going to open there whether anyone likes it or not, might as well let them beautify a historic building. Certainly is better that the environmentally disastrous eyesore that is the Galleria.

2011-11-28 19:12:39 | Chris Phelan - Really? Outside council? So your city attorney took you down the primrose path and wasted monies and now you feel the need to double down and put it all on the table? How much are you willing to waste on this, because it is not going away. Just drop it, save the tax payers money, and live with the pretty painting. @ Karen Miller, I doubt our taste match, but I would never be foolish enough to try to tell you what should be "fine art" as that is always in the eye of the beholder. Judge all you want, just don't judge things for me, you worry about yourself and your property. Little hitlers, I bet Bee Caves busts lemonade stand too right?
-
2011-11-29 07:56:29 | Karen Miller - Chris PhelanI do not believe in any of my comments I stated that I was selecting what you should have as fine art. I simply gave an opinion and gave an example. Did I resort to name calling and using the word "hitler?" No, I did not. As a senior citizen I am amazed at what the young consider art. Art is in the eye of the beholder and there is pop art, folk art, etc. This would not in any art world be classified as "fine." Your comments, Chris, speak volumes of who you are and what you stand for. Before you throw around the word "hitler", let me share with you that we lived through Hitler and the rebuilding of Europe; and I am not of his kind. We have all come to know who uses that term. Again, what I expressed was free speech and opinion without name calling. And one should worry beyond themselves and their property. I believe your statement is telling one what to do.

2011-12-05 00:32:11 | Anonymous - Without Name Calling? To quote your original post Karen -- "In Planet K's situation it is what comes out of the backside of the duck."
Is that what you would define "without name calling?" Don't put yourself on such a high pedestal in light of doing exactly what you accuse Chris of. Define "fine" art as you see fit, and let others define it as they see fit. Who made you the authority on the matter?
-
2011-11-28 19:14:27 | Joe Coleman - Federal Court? Really?Wow. I expected this sort of garbage from other close-minded areas of the county, but NOT the city of Austin. This is downright stupid. Ok, you kids all go stand in your corners for time out. And stop tracking mud across my nice clean carpet! And don't fidget when I talk to you! And don't talk with your mouth full.

2011-11-28 21:22:29 | Patti EverettI think its shows passersby of our wonderful, colorful life in central Tx, Bee Caves...the gateway to the Texas Hill Country. The art work truly represents of life here, not the council

2011-11-29 09:32:30 | AnonymousDo we really need a clock tower the size of Big Ben in the city?
How was that approved? Maybe since the mayor holds an administrative position at St David's Medical Center that had something to do with it.
You know what they say, " It's not what you know but, who you know".
BeeCave has a vast amount of talented & educated citizens, please consider running against this current bunch. Don't be like Lakeway where the citizens get thrown out of city council meetings for speaking the truth.
No city is perfect, but to let things like this happen and just blog about it or complain and not do anything to correct them is just plain foolish.
-
2011-11-29 10:20:14 | ElijahPlanet k should paint the faces of the city council & administrators into the existing sign like a little Mt. Rushmore, the city won't have a problem calling it art then. Nothing would cheer uP the narcasists more than staring at their own faces all day.

2011-12-02 00:55:54 | Anonymous - Boycott - Feel Free to JoinI've come to the conclusion after reading the latest LT View article today about the Planet K "sign" being non-conforming, any chance I have to shop outside of Bee Cave, I will gladly make that choice. Don't want to contribute one red cent of my sales tax money to such a town. I really enjoyed the quote from once council member in the article that the "Pursuit of Happiness" had no historical meaning - had that person ever heard of the Declaration of Independence. I've never shopped at a Planet K, but I certainly stand strongly behind their right to open and sell legal goods to whomever might want to shop there.

2011-12-02 09:36:45 | KellyLet's please not reflect the tone of Lakeway. They took a perfectly lovely place that I wouldn't mind living in (except the inability to have a gas stove but that is neither here nor there) and ruined it. I choose Bee Cave because it seemed a little more enlightened, and I know others who feel the same way. There has to be a happy medium that keeps the city interesting while maintaining balance and some consistency. Given the reaction to the mural from this council I'm surprised there have not been objections to Hey Cupcake (which I love and would like to see more cute food trailers and maybe seating- think we can partner with the vendors to pay for something nice like a little food court with picnic benches and covering/pavilion?) How many people live here because it is NOT LAKEWAY-- yet here we are... Let's not go down the same path as Lakeway and let's keep Bee Cave liveable for everyone.

2011-12-05 15:20:45 | JoshWhat would happen if the planet k people take down the mural causing all the noise? What would the city have to say then?
They'll just find another loophole to deny them a permit.
I'd be interested to see what other excuses the city comes up with.

2011-12-06 12:29:37 | Barb - Send these messages where they will hit their markI agree wholeheartedly with most of the comments that have been written, and I hope that each of the writers have expressed their opinions directly to the Bee Cave City Council, as well as venting here.
I'm very happy with the beautiful mural, and hate the realization that the City Council is trying to make this small city a "vanilla" replica of every other suburb in America. I don't want it to be visually interchangeable with the outskirts of San Diego or Boise or Kansas City. When people travel through, I want them to know they are in or near Austin, a unique, flavorful town.

2011-12-07 18:28:53 | Mark - Rudeness. If being rude was the way to make people side with you, then those who want the store would win hands down! Name calling is something you hear on the playground, not among adults.
Accurate facts might also come in handy. The clock tower isn't anywhere near the same size as Big Ben. I can imagine, however, that it's size might prove useful to someone (especially those who don't live in the area) looking for emergency care during the night.
The mural isn't in Austin-it's in the City of Bee Cave.
I agree with Karen and the use of the "h" word. Nobody on the council has ever committed the atrocities that the word brings to mind.
If you go to one of the city meetings you will see how many residents are opposed to this store.
-
2011-12-09 02:36:20 | Andy - Re "Little Hitler"Mark, keep things in perspective, no one has accused Bee Cave of committing any of the atrocities committed by Hitler. Just that they fall within the below definition quoted from urbandictionary.com - a very common use of the term:
"A little hitler is a self-important tosspot who thinks he's in charge. Someone who makes up arbitrary and/or self-serving rules and has a tantrum if they aren't obeyed. They tend to have a park-keeper/traffic-warden mentality; rules are Law and rules come first. They can't handle people who threaten their authority."

Maybe, the city wanted a storage room for all their precious fine artwork.

2011-12-08 14:29:17 | Travis residentDear Elijah,
I agree with your idea of painting the city council members faces on planet k's mural. They can then call it abstract art since they're deformed.
