City takes Planet K to its own court

In a very low key move, Bee Cave City Council is believed to have filed a complaint with its own Municipal Court against Planet K following the recent erection of a mural at the old Trading Post building on Highway 71. In the continuing battle to prevent the opening of a so called "head shop" the City has filed a complaint with a court that it actually funds and where the judge reports to the City Council.

2011-07-28 20:00:10 | nomadHAR - not for kids, learn to readhow is it a threat to kids if only people 18 years old and older can enter?
you know what is the real threat to children? lazy parents that blame media and everything but themselves for their childrens' behaviour. learn to actually be a part of your child's life.
whenever someone says 'for the children', they actually mean, 'for me, but i know i will get better responses if i say for the children.' people that actually care and advocate for children never have to say that, it is implied in their work.
full disclosure: i am a former high school teacher and college professor. the parents that actually attended special days and extracurricular activities always have kids that give me no trouble at all in class.

2011-07-16 09:48:47 | Bee Sting - The Law West Of The PulpitThe Bee Cave City Council should declare public domain over the the old trading post salon and hold Municipal Court there. Hang a couple of Hippies and get this over with.
Judge Roy Bean would be proud.

2011-07-16 10:09:00 | LUPE ELGHOUL - CITY COUNCIL + POLICE DEPT. = DUKES OF HAZARDI agree with you Danny. I don't understand why the residents of this city allow the town to be run like the Dukes of Hazard. Changes aren't going to happen if people just keep their heads in the sand. I hope that people step forward and run against the present council members. I was told by City Administrator, Frank Salvato that in order to hold elections in May there has to be three candidates or else the elections will be cancelled. Like what happened last May.
I've never seen a city that allows spouses on the city council either. Did you know that Mayor Murphy's husband serves on the board? I could only imagine what kind of loophole they used in order to say that this is within city policy and procedure.
Did you know that the Bee Cave police dept. doesn't have an internal affairs bureau or even a citizen review board like many smaller cities? Good luck trying to complaint against an officer. The dept will direct you to one of their own who heads up the investigation. You can see what I'm talking about if you look through the police annual report from 2010 on the city's website. Apparently, the Mayor and police chief didn't think it was a conflict of interest when I showed them the photo of the Detective hugging and smiling with 2 other officers - one of whom was the one being investigated. This photo was posted on their own annual report, if this doesn't raise a red flag you should have your head examined. They said it was within dept. policy and procedures. This is a calamity! It's obvious that this city doesn't believe in a system of checks and balances for their police dept. and feels that minimal supervision of its officers is sufficient. This assumption is both dangerous and unacceptable. This lack of accountability needs to be addressed immediately. A civilian police review board would assist the police dept. with investigating misconduct, which currently unchecked, may expose the city to litigation. Both Lakeway and Austin have internal affairs departments and in fact, Chief Acevedo from Austin police dept. is looking to implement a civilian review board in addition to their internal affairs bureau.
I knew this city was on the " shyster" list when Judge Stick resigned last year. It was alleged that he was accepting donations to the city from DWI violators for a lesser sentence. His own municipal court clerk was the whistleblower. I don't know the outcome. His replacement is Judge Garza. Residents should show up for the city council meetings held every other Tuesday at 6pm at the City Hall in the Hill Country Galleria.
The residents elected this council to represent their views and concerns. Don't you think you should be informed as to whether or not your views and concerns are being addressed? This once sleepy village is now a city and has grown 400 % from one city statistic I've read. It needs a wakeup call to join the rest of the world in 2011. You owe it to yourselves to get involved in this city if you reside here. If not, don't complaint when there is another kink in the chain.

2011-07-17 13:26:56 | Bob - No stoners in Bee CaveThe stoners just don't get it. The majority of the taxpaying residents do not want a head shop in Bee Cave. The aging hippies of Bee Cave will just have to continue to get their bongs, papers, and sexual devices where they buy them now.
The "artwork" that adorns the Trading Post looks like stoner graffiti, nothing more.
Whine all you want stoners, you won't be successful here.

2011-07-28 20:04:05 | nomadHAR - how about letting capitalism decided that?if you are so sure it will fail, let it go up. what are all of you so afraid of?
remember capitalism and free trade? remember your economics and history classes? or i guess you would rather your town to run like North Korea where you control every aspect of commerce.

2011-07-23 15:02:58 | pegasus6 - Planet K - Live and Let LiveI think the mural is a great add to Rt 71. I applaud the owners of Planet K's tenacity in fighting narrow minded bigoted people. If you don't like the store or what it sells don't shop there. I would bet that most of the people who have something negative to say about the store have never been in a Planet K. They have great gifts, cards, candles, and a variety of novelties. It is one of the few places in town where I have been able to buy "Over the Hill" t-shirts and gag gifts.
Get a life people and stop trampling on other peoples livelihoods.

2011-07-25 19:51:28 | simplesimon - prevention vs curethe sad fact is that when the zoning regs were writ , no one thought about a planetk type business so if ok on that point then probably legal. the widening of 71 seems to have killed the site as a resturant and to me it seems a legal if somewhat tacky business.
don't know the city is up to with this complaint in city court but the owner has 8 or 9 of these stores, enough money for lawyers, and a need for publicity so the city court case will likely be followed by an appeal to a higher court that may be less concerned woth our image.Since everyone likes the mural so much, wait. The store on Stassney has an old junk car brightly painted w/o top planted with cactus and he probably has enough frontage for it. i am enjoying the debate but feel planet k may be the way to bet.

Voters and thinkers should be angry and appalled over how the City of Bee Cave has handled this whole situation. In a nutshell, a few hard-right wingers (religious) got a hold of a few city council members and demanded they stop this horror of a retail store. As a result, they have embarrassed themselves and the City. There has been nothing done in a professional, thoughtful manner. And the clowns continue with the circus act with this latest laughable idiotic "complaint". They should all be voted out.
